Q: We have decided to outsource our cleaning and know TUPE applies but one of our long-serving staff says the company we have chosen is rubbish and she won’t transfer her employment to them. What happens next?

A: She is probably feeling very vulnerable if she has been with you a long time. Try and arrange a meeting for her with the new company so they can reassure her. However, if she refuses to transfer then she will effectively have resigned.
